Video Transcribed: Who will a child be placed with after an emergency custody hearing? Hi, I’m Brian Glass, a lawyer in Chickasha, Oklahoma.
After an emergency custody hearing, there will be a determination on where the child will be placed moving forward. The first one of course is if there has not been enough evidence produced to rise to the level of emergency custody, then the child will be placed back in the home back with their legal guardian, the parent, or the person who is in their care.
The second place they will go is to a family member or a licensed entity that is in the business of taking in children that have been removed from the home due to an emergency custody ruling. And further, if there’s no one available there, the state can also determine that the child should be left in DHS custody, whether that be for actions of the child or circumstances surrounding the child, if they’re a victim of any kind of domestic violence or if no one can be found that can take the child in.
