Understanding Child Support Modification in Oklahoma
Can child support be modified in the state of Oklahoma? Hi, I’m Oklahoma Attorney Brian Glass and I often get the question, what do I do or how can I modify my child support in Oklahoma? Well, the answer to this is you can do it through the courts, through a district court order, or administratively through the child support offices. What constitutes this change is there needs to be a material and significant change in circumstances, meaning that you, you know, A, you lost your job or, you know, B, you got a new job. Either you significantly, you know, increased or decreased your income at the time. Either one of these would be cause for a modification of child support just depending on the circumstances.
And this can be, you know, raising or lowering of income on either side of the child support case. One thing to consider is you can’t be what the courts consider purposely underemployed. So you can’t quit your, you know, six-figure job and go get a minimum wage job just to avoid a child support obligation. The courts will look at what your earning potential is and they could potentially impute you at a higher level even though you’re making a significantly lower amount of money.
