Video Transcribed: How is embezzlement defined by the state of Oklahoma? Hi, I’m Oklahoma lawyer Brian Glass.
Embezzlement is the fraudulent appropriation of the property of any person or legal entity legally obtained to use for a purpose not intended or authorized by its owner. This means that you were entrusted with a certain amount of property, you took that property and used it the way you saw fit. You either could steal money from a cash register. You could steal money from a bank account and trust.
If you were a trustee on a bank account or on a trust account, and you used that money to do any number of personal things. You paid your rent with it. You went to the grocery store when the person that entrusted you with the money wanted you to pay their bills or to put it in the bank or not touch it, just to keep it safe.
Any of these things can be considered embezzlement, which means the person would initially have to have legal access to the funds or property. And then from there, they used them in a way not authorized by the owner. This could look any number of ways.
