The Complete List of Those Responsible for a Child’s Welfare
Video Transcribed: Who qualifies as a person that is responsible for a child’s health, safety, and welfare? Hi, I’m Chickasha attorney Brian Glass, and there’s a laundry list of people who may qualify for a person who is responsible for the health, safety, or welfare of a minor child.
The first of these is the obvious, parent, legal guardian, custodian, or foster parent. These people have legal rights either through natural birth or through court proceedings. One way or another, they are the person responsible for the child, and they are listed as the first and foremost person responsible for the health, safety, and welfare of minor children, or the minor child in question, excuse me. Next, I would list a person 18 years or older that either the parent has left with them or cohabitates with the parent and they’re at least three years older than the child. That person would be the person responsible for the health, safety, and welfare of a specific minor child.
Also, not only do they cohabitate, but if they happen to be residing there for even a short time, that person can also be responsible as long as they are at least three years older than the minor child in question. Any owner, operator, agent, or employee of any private or residential home institution, facility, or day treatment program. This means most businesses, if there’s a minor child present, then you could be responsible for that child. Also, any intimate partner of any of those previously listed people, the parent, legal guardian, custodian, or foster parent, and any of their significant others will also be a person that’ll be responsible for the health, safety, and welfare of the minor child.
Also, any person who voluntarily accepts care of a child, whether it be professional daycare, babysitter, or just your neighbor that watches them, they’ll be considered… For the purposes of child safety, they’re considered a person responsible for the child’s health, safety, and welfare in regard to the courts.
